RETURNS & WARRANTY POLICY

1. Change-of-Mind Returns
Upperhand Performance Products does not offer change-of-mind returns or exchanges.
This includes products that have been incorrectly ordered by the customer, are no longer required, or are determined by the customer after purchase to be unsuitable for their intended application.
Customers should confirm product suitability and compatibility before placing an order.
This policy does not affect any rights or remedies available under the Australian Consumer Law.
2. Faulty, Defective or Incorrect Products
If you receive a product that is faulty, defective, damaged or materially different from the product ordered, please contact us as soon as reasonably practicable.
Please provide:
Your order number or proof of purchase;
Your name and contact details;
Product details;
A description of the issue; and
Photographs or video where appropriate.
We may request additional information or require the product to be returned for inspection.
3. UPP 12-Month Warranty
Unless otherwise stated, UPP provides a 12-month voluntary warranty from the date of sale against defects in materials and workmanship.
This warranty is provided in addition to, and does not replace, any rights available under the Australian Consumer Law.
The 12-month warranty period does not limit or replace consumer guarantees that may apply beyond that period.
4. What the Warranty Covers
Subject to the terms of this policy, the UPP warranty covers defects in materials and workmanship that arise during the applicable warranty period.
Where a valid warranty claim is accepted, UPP may, as appropriate:
The appropriate remedy will depend on the nature of the issue and the customer's applicable legal rights.
5. What the Warranty Does Not Cover
To the maximum extent permitted by law, the voluntary warranty does not cover damage or failure resulting from:
Incorrect installation;
Incorrect assembly;
Incorrect torque or fastening;
Improper use;
Abuse or misuse;
Accident or impact;
Unauthorised modification;
Drilling, cutting, machining, grinding, welding or other alteration;
Use outside the intended application;
Use with incompatible components;
Failure to follow installation instructions;
Incorrect adjustment;
Neglect;
Corrosion or environmental damage;
Normal wear and tear;
Competition or extreme use where the product was not represented as suitable for that application; or
Other damage caused by circumstances outside the intended use of the product.
These exclusions do not exclude or limit any rights that cannot legally be excluded.
6. Safety-Critical Products
Certain UPP products are safety-critical automotive components.
These products must be installed by suitably qualified and competent persons using appropriate tools, equipment and procedures.
Where a product is incorrectly installed, modified or used outside its intended application, it may fail or adversely affect vehicle safety.
Customers must follow all product-specific installation instructions and safety warnings.
For brake, steering, suspension, structural and other safety-critical components, professional installation is strongly recommended.
7. Warranty Claim Process
To submit a warranty claim, contact UPP at:

Please provide your proof of purchase and details of the problem.
UPP may require the product to be returned for inspection.
Products returned for assessment must be adequately packaged to prevent damage during transportation.
Do not return a product without first contacting UPP and receiving return instructions.
8. Warranty Assessment
A product may need to be inspected or tested before a warranty determination can be made.
Where an inspection determines that the problem is not covered by the voluntary warranty, UPP will notify the customer.
Where applicable, customers may be responsible for return freight or other reasonable costs associated with assessment of a claim that is not a valid warranty claim, subject to applicable law.
9. International Warranty Claims
UPP accepts international warranty claims.
International customers may be required to return products to Australia for assessment.
Where a warranty claim is accepted, UPP will determine the appropriate remedy in accordance with the applicable warranty and law.
Unless otherwise required by applicable law, UPP does not accept responsibility for customs duties, taxes, brokerage fees or other import/export charges associated with international warranty returns.
10. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
These rights are automatic where applicable and operate independently of the voluntary 12-month UPP warranty.
A consumer may have rights under the Australian Consumer Law after the expiry of the 12-month voluntary warranty.
11. No Exclusion of Statutory Rights
Nothing in this Warranty Policy is intended to exclude, restrict or modify any consumer guarantee, right, remedy or liability that cannot legally be excluded, restricted or modified.
Where this Warranty Policy conflicts with a mandatory requirement of applicable law, the mandatory legal requirement will apply.
